Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Vesper application (the "Service") operated by the provider of Vesper ("The Service Provider").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.
1. Accounts
When you create an account, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password(s), especially conversation-specific passwords.
2. Intellectual Property
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of The Service Provider. The Service is protected by copyright, trademark, and other laws. Trademarks and trade dress associated with Vesper may not be used in connection with any product or service without the prior written consent of The Service Provider.
3. User Conduct and Responsibility
You agree not to use the Service:
- For any unlawful purpose or in any way that violates any applicable national or international law or regulation. This includes, but is not limited to, activities related to terrorism, fraud, harassment, distribution of illegal content, or any other criminal offense.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate The Service Provider, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by The Service Provider, may harm Vesper or users of the Service or expose them to liability.
You are solely responsible for the content of your communications and your conversations, and for all activities conducted under your account. You agree that you will use the Service in compliance with all applicable laws and regulations. By using the Service, you consent to take full responsibility for your actions and communications.
Cooperation with Law Enforcement: While Vesper is designed for privacy using end-to-end encryption, it must not be used for illegal activities. You acknowledge that The Service Provider may cooperate with law enforcement authorities regarding investigations into alleged criminal activity conducted using the Service, to the extent required by law and permitted by the Service's technical limitations (zero-knowledge architecture). This cooperation may involve providing limited user data possessed, if any, as legally mandated.
4. Termination
Access to the Service may be terminated or suspended immediately, without prior notice or liability, under the sole discretion of The Service Provider, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
5. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
The Service Provider does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
6. Limitation Of Liability
In no event shall The Service Provider be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) unauthorized access, use or alteration of your transmissions or content; (v) your violation of any applicable laws or regulations; or (vi) any other matter relating to the Service, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
You expressly agree that The Service Provider shall not be liable for any damages or losses arising from your use of the Service for illegal activities or from any security breach resulting from your failure to protect your passwords or device. You agree to indemnify and hold The Service Provider harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your improper use of the Service, or your violation of any law or the rights of a third party.
You are solely responsible for backing up your data and managing your encryption keys and passwords. The Service Provider is not responsible for data loss due to forgotten passwords, device failure, user error, or any other reason. The Service is provided "AS IS", and all liability is disclaimed to the maximum extent permitted by law.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
8. Changes
The Service Provider reserves the right, at sole discretion, to modify or replace these Terms at any time. If a revision is material, reasonable notice will be provided prior to any new terms taking effect.
